Terms & Conditions

PLEASE NOTE ABOUT SAMPLES AND PRIOR TO PLACING ANY ORDER It is important to order a sample BEFORE placing a larger order. Product colors & sizes vary by each production run. We post photos that best represent our items; however, the computer images do not 100% accurately represent the actual tile/hardwood color, texture, and graining. Due to the various manufacturer production runs, it is imperative to order a sample from us first, BEFORE placing your order. Only seeing and feeling the product in person, in the light of your final installation area will accurately reflect the look of your desired outcome. In addition, please note the actual size may vary slightly than indicated on our website since most manufacturer's list "nominal" sizes.  NOTE: Only one same of each item is permitted (per individual order or multiple orders) unless Tile Time Online approves in advance of the customer placing a sample order.  Any item over 12"x24" will be a cut piece.

Showroom Pick-Up

Most, but not all, of the flooring products sold on our website can be picked-up at our showroom in Rockledge, PA for a fee of $200.00.  All orders picked-up at our showroom are subject to 6% PA sales tax.  Call 215-837-1544 or email us at info@tiletimeonline.com to see if the product you are looking for qualifies for the showroom pick-up option.  Please note that orders larger than 400 sq. feet can not be picked-up at our sample showroom as we are located in historic Jenkintown in a residential area where there is no parking lot or loading dock.  ALL SHOWROOM PICK-UP ORDERS MUST BE PICKED-UP WITHIN 1 WEEK FROM WHEN THE ORDER IS DELIVERED TO OUR SHOWROOM DUE TO LACK OF SPACE.  ORDERS NOT PICKED-UP AFTER THEN COULD BE SUBJECT TO A $35/DAY STORAGE FEE.

General

Whether placing an order directly on our website or a phone order all Terms and Conditions (T&C) apply and they are set forth below shall be legally binding on you, the Buyer.  You, The buyer, hereby acknowledge and agree that the terms may be modified, updated, amended or revised in any manner by us, the Company, from time to time without notice to you.

The Company reserves the right, at its sole discretion, to change, suspend or discontinue any aspect of the site, as well as change, modify, add or remove products offered for purchase on the Site at any time.

NO CLAIMS CAN BE MADE AFTER ANY OF OUR PRODUCTS ARE INSTALLED.  Please look at your order prior to installing and contact Tile Time if there are any issues or concerns.

 

Payment Terms

Payment in full is due at the time of purchase.  We accept Visa, Master Card, Discover & American Express credit/debit cards.  IMPORTANT IF YOU ARE MAKING YOUR PURCHASE WITH AMERICAN EXPRESS AND THEN DECIDE TO CANCEL YOUR ORDER WE WILL REFUND YOUR CREDIT CARD LESS A 5% FEE THAT AMERICAN EXPRESS CHARGES US.

 

Warranty

You hereby acknowledge and agree that the Company is not a manufacturer or importer of any product sold on this Site.  The products are subject to the warranty provided by the manufacturer of the product only.

The Company hereby expressly disclaims all warranties either expressed or implied, including, without limitation, any warranty or merchantability or fitness for a particular purpose.  The Company’s sole warranty is that upon fulfillment and execution of all the stipulations, provisions, requirements and specifications of these terms, the Company shall supply the ordered products.

This disclaimer by the Company in no way affects the terms of the manufacturer’s warranty, if any.

The Buyer hereby acknowledges and agrees that the Company is in no way responsible and/or liable for the breach of warranty terms by the customer or the manufacturer of the product.

 

Natural Stone Information

Natural Stone is a product of nature and therefore pieces will not be duplicated in any manner. You can expect varying degrees of color, veining, finishes and fills in your product which enhances it's beauty. The stone that is shipped to you may or may not be a direct match of the sample that the product was chosen from, it may have some inherent shade variation. The sample may or may not blend with the product that was delivered.

Please check your tile before installation. Carefully open up a few cartons and "dry lay" the product on the floor to make sure that you are satisfied with the overall look. When the product is installed it should be pulled from multiple cartons. If you received multiple pallets/crates, the tile should be mixed from crates & cartons.

 

Rectangle (Plank) Tile Information

During the manufacturing process of these tiles the material is pressed and that may cause a slight bowing effect. This is to be expected in the production and is not a manufacturing defect. It will be neutralized during installation if the proper procedure is followed. If you are looking for a "staggered" installation they must be installed using a 1/3 or 1/4 stagger. If the installation is at 1/2 it may exaggerate any slight bowing produced during manufacturing. Any 1/2 stagger installation will be rejected as a claim.

 

Tile Size

All measurements listed for the size of tiles are "nominal" measurements and may or may not be the actual size of the tile.  Furthermore, some tiles from the same series/style/color can have different thicknesses.  For example, a 12"x24" and 12"x12" tile can have different thickesses.  If mixing tiles of different sizes on a floor please check with Tile Time Online prior to placing an order.  Otherwise it will be assumed that the different sizes will be installed in different rooms.

 

Free Shipping Items - Restrictions

There are limitations to the areas in the continental US for free shipping items such as Cape Cod, MA, Hilton Head, SC and other remote areas not easily accessible for our carriers. Please call 215-837-1544 to see if there is a restriction to your home/business prior to placing an order.

 

Product Availability

The Buyer acknowledges that the Company is in no way liable if a product previously purchased on this Site has been discontinued by the manufacturer and is no longer available.  You further acknowledge that the Company is not liable for any costs associated with material no longer available to complete and/or add-on to a project such as any materials previously purchased on this Site as well as any labor costs associated with installing and/or removing said product.  Furthermore, if a product was purchased, sold and delivered to the customer but has since been discontinued and no longer available Tile Time Online will not accept any returns on those item(s).

 

Order Cancellation

An order may be cancelled by written notice to the Company within 12 hours from being placed through the Site without any penalty (with the exception of orders placed using American Express) or cost to you unless the order has already shipped and if so will be subjected to the conditions below.  An order cancelled after 24 hours from being placed shall be subjected to the Company’s return policy, as described below. Once an order has shipped it can not be canceled without a 30% restock charge as well as all associated shipping costs.  Any purchase made with American Express and then cancelled prior to shipping will be refunded the total amount LESS a 5% fee that American Express charges us regradless of whether the order has shipped or not.

If an item sold on our website is a Special Order there will be no refunds, returns or exchanges after the order is placed.  Tile Time Online will email the customer notifying if the order that they placed is indeed a Special Order prior to them placing the order with the factory.  If the customer decides they do not want the Special Order they will notify Tile Time in writing before the order has been placed at the factory.

 

Return Policy

The Company will not accept return of any goods unless prior written approval has been given.  Under no circumstances will we accept returned merchandise if it is not in its original package and in resalable condition and must be within 14 days from the date of purchase or 7 days from the date the product was delivered to you, whichever is later.  No returns will be accepted on any special order or non-stock items.

The following additional conditions and stipulations apply to all returned items:

  • You will send written notification to the Company which shall be dated and include a list of the items to be returned and their respective item codes, Return Merchandise Authorization Number (obtained from the Company), the date the shipment was received, the Invoice Number under which the shipment was delivered and the reason for the return.
  • You, the Buyer, shall package the material back in the way it was received.  If the order was received by LTL carrier it must be returned by LTL carrier, the items must be securely packaged on the pallets/crates that they came in and then shrunk wrapped with plastic.
  • You will receive a refund for the returned material within 30 days from receipt of such items by the Company less a restocking fee in an amount equaling 30% of the price paid for each returned item plus shipping cost back to us.Also, the original shipping charges will not be refunded.
  • You, the Buyer, shall bear all of the costs associated with shipping the returned material back to the Company.
  • No claims will be accepted on any material that is installed.
  • No refunds or exchanges will be accepted on any items that are Special Ordered.
  • We will not accept returns on any sample orders, decorative tiles, bullnose or trim tiles, grout or setting materials.

 

Hold Harmless

In no event will the Company be liable for personal injury, property damage or any other loss related to any of the products sold on its Site or in the delivery of such products.

The Buyer shall defend, indemnify and hold harmless the Company and its agents and employees against loss, damage, claim, suit, liability, judgement or expense (including without limitation, attorney’s fees) arising out of or in connection with any injury, disease or death of persons (including, without limitation, Buyer’s employees and agents) or damage to or loss of any property, or violation of any applicable laws or regulations resulting from or in connection with the sale, transportation, installation, use or repair of the products to the Buyer.

 

Shipping Terms and Conditions

Tile Time Online strives to ship every order as soon as possible, however, you hereby acknowledge and agree that the Company is not responsible nor liable in any way for delays in the shipment of your order caused by stock limitations, manufacturing delays, and/or force majeure.  The Company does not guarantee the delivery time of any order and has the right to change the shipping carrier.   We ship to all States in the continental United States.  Orders are usually shipped within three (3) business days from the date the order is placed.  In the event that the shipping date is later than fourteen (14) business days, the Company will contact you and inform you of the expected shipping time frame.

You hereby acknowledge and agree that the Company’s sole role in the shipping of your order is to procure shipping services on your behalf and arrange the shipment of your order on your behalf.  For that purpose you hereby grant the Company the right to choose the freight carrier or shipper and share with the freight carriers and shipping companies your order information.  Tile Time Online reserves the right to change and/or modify the shipper and/or shipping method at their discretion for ease of delivery.

Delivery and pick-up returns to remote locations:  All freight (LTL carrier) deliveries can only be delivered to locations on paved roads.  Failure to notify Tile Time Online prior to placing an order to delivery to said locations with unpaved roads/small access bridges, weight restricted access roads, etc., will result in the customer paying for any additional charges for reconsignment/delivery; this also applies to all returns and unwanted orders.  All returns must also be returned in the same condition as delivered, shrink-wrapped and on pallets.  The customer is responsible for any additional charges incurred to re-palletize, shrink wrap, and relocating the material to a pick-up location where the order was originally left by the carrier so that the a freight truck can pick-up the return.  The customer must contact Tile Time Online for all returns prior to moving a returned order to a paved location (the original drop location).  Freight trucks will NOT deliver to nor pick-up from non-paved road locations.  Please note, all additional charges as mentioned above, for returned products will be deducted from the return refund after the return is received at the warehouse.

When an order is shipped via LTL (Less Than Truckload) carrier, Tile Time Online is not responsible for any storage fees that result from the Buyer not being available to accept the delivery in a timely manner. The LTL carrier will allow 3 days free storage, after that a storage fee of $50.00/day will apply. The Buyer is responsible for all storage fees and these must be paid in full prior to the delivery of the order.  If the customer fails to respond to telephone calls to schedule delivery Tile Time will attempt to contact by phone and email.  If after three failed attempts to contact the Customer the order will be returned to the shipping warehouse.  The Customer is responsible for all shipping fees from and to the warehouse as well as a 30% restocking charge fee.

All orders placed on our website and shipped via LTL carrier (such as Estes Express, R&L Carriers, Pitt Ohio, Central Transport, etc.) assume that they will be residential curbside delivery and the truck unless specifically noted on Tile Time's order Receipt.  Any additional requests MUST be made to Tile Time in writing prior to placing the order (such inside delivery, etc.) so that the appropriate fees can be added to the order.  If additional fees that were not authorized by Tile Time and have been invoiced by the carrier Tile Time will email the customer the said invoice for such services/fees and the customer is required to pay Tile Time within 5 business days.  If not, Tile Time will charge interest on the owed fee 1% per day.

If an order has items that come from multiple wholesaler's and/or supplier's Tile Time Online reserves the right to notify the customer that additional shipping costs could apply. In this case Tile Time Online will contact the customer via email and inform them of the additional shipping cost. The customer will have to pay the additional cost prior to shipment or Tile Time Online will issue a full refund to if they would like to cancel the order. You further acknowledge and agree that the Company is not a carrier nor shipper and thus does not bear any responsibility and/or liability for the shipping of your order, the timely delivery thereof and/or damages and/or expenses incurred by you in connection with such shipping.  The shipping of your order is the sole responsibility of the freight carrier, in accordance with the terms of shipping of the applicable carrier.  Thus any claim, dispute or demand regarding the shipping of your order will be taken up directly with the carrier and you hereby indemnify and hold the Company harmless from any claim, loss, damage, liability or cost asserted against or incurred by you that is related to the shipping of your order.

The Company shall obtain the applicable carrier’s acknowledgement that your order was collected by that carrier in good condition and in full at the facilities of the Company or another location designated by the Company.

Tile Time Online does not ship outside of the continental United States but can ship to a logistic company that the customer hires to ship overseas. It is the customer's responsibility to check the order for damaged or missing tile at time of delivery and note damage of driver's Bill of Lading. The customer shall then notify Tile Time within 24 hours of delivery of any damage/missing product and Tile Time Online will promptly ship replacement. Tile Time Online is not responsible for any tariffs, taxes or fees that could apply to such shipments.

Tile Time Online can not ship tile orders that have items larger than 18" via Fed Ex or UPS (except samples) due to limitations in packaging.  Please choose the LTL (less than truckload) option for these items.

The Fed Ex shipping delivery dates reflected on our website may not be accurate since we ship from numerous warehouses/factories throughout the US. Please call 215-837-1544 to obtain an accurate shipping time. If Tile Time does not hear from the customer it is implied that packing times of 2-3 days are acceptable.

 

Receiving Terms and Conditions

Immediately upon its delivery, in the presence of the carrier’s representative, you shall physically inspect the condition that your order was delivered. If there is visible damage or missing items you must note it on the carrier's paperwork, take pictures of any damaged items and then contact Tile Time Online within 24 hours. Please do not discard any damaged tile but give the broken tile directly to the carrier's driver and have this noted on the carrier's paperwork.  The customer agrees to take clear pictures showing any broken tile/items and email them to Tile Time.  Note that torn packaging does not consitute that the items inside are broken or damged. THE CUSTOMER AGREES THAT THEY MUST REMOVE ANY DAMAGED/BROKEN ITEMS AND EMAIL THE PICTURE TO TILE TIME IN ONE PICTURE SO THE WE CAN OBTAIN AN ACCURATE COUNT FOR THE CLAIM.  Note that unless you have done so within the time frame mentioned above, your acceptance of the shipment from the carrier is an acknowledgement that the product has been delivered complete and in good condition thus relieving the carrier from any liability.

Since mosaic tiles consist of many smaller tiles with a mesh backing if any broken small tiles are noted Tile Time will send the appropriate number of sheets required to replace those individually broken tiles.

If you receive an order from Fed Ex or UPS please open and inspect the package(s) for any damage. If damaged tiles are found, do not discard the packaging or any tile. Call Tile Time Online to report the damage within 24 hours of receiving your order to report any damaged tile and we will send you replacement tile. In most cases Fed Ex & UPS will want you to put the damaged tile back in the original packaging and place it on your front porch where they will pick-up and ship back to us. This will assist Tile Time Online in it's claim with Fed Ex or UPS but please note that we will ship replacement tile immediately upon notification from the customer.

 

 

Samples

Tile Time can not ship any samples that are longer than 24" due to packaging restraints. All tile samples that are longer will consist of a cut piece to accommodate the packaging currently available.

 

Hardwood Shipping

Natural solid and engineered hardwood flooring can not be shipped via Fed Ex/UPS. Please select the LTL (less than truckload) option while placing an order.

 

Happy Floors Quotes & Orders

Tile Time will not provide any quotes for Happy Floors tile unless the request exceeds 250 square feet.

Since Tile Time Online is a registered eCommerce business in the state of Pennsylvania and Happy Floors is based out of and ships from the state of Florida it is up to the customer to file and pay any Florida state sales taxes for orders that ship to the state of Florida.

 

Errors, Omissions and Changes

While the Company attempts to ensure the accuracy of all materials presented within this Site, the Company makes no warranties or representations as to its accuracy, and the user of this Site is warned that this service could include typographical errors, technical inaccuracies, and/or errors or omissions.  The Company reserves the right to make improvements and/or changes at any time and we reserve the right to make changes to our Site and these disclaimers, terms and conditions at any time.  Product prices that are listed on this Site are subject to change at the sole discretion of the Company.  In the event that a product is listed at an incorrect price or with other incorrect information due to typographical or other error, the Company has the right to refuse or cancel any orders placed for the product listed incorrectly.

 

Taxes

The Buyer acknowledges and agrees to pay any applicable sales, excise or other taxes to the products they purchase on this Site.  Any taxes which the Company may be required to pay or collect under any existing or future law, upon or with respect to the sale, purchase, delivery, storage, processing, use or consumption of any of the products shall be the responsibility of the Buyer.   

 

Applicable Law and General Terms

These Terms, any other policies or guidelines referenced herein contained in this Site constitute the entire agreement between the Company and you.

This Site is created and controlled by the Company, in the State of Pennsylvania, USA.  These Terms and the relationship between you and the Company will be governed by the laws of the State of Pennsylvania without regard to its conflict of law provisions.  You and the Company hereby expressly and freely agree to submit to the personal  and exclusive jurisdiction of the courts located within the County of Montgomery, Pennsylvania.

Tile Time Online takes seriously any false allegations or slanderous comments that are posted online or via any social media forums and will prosecute in the courts located within the County of Montgomery, Pennsylvania.

The failure of the Company to exercise or enforce any right or provision of these Terms will not constitute a waiver of such right or provision.  If any provision of these Terms is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms remain in full force and effect.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the service or these Terms must be filed within ninety (90) days after such claim or cause of action arose or be forever barred.

If an order was entered by a Tile Time Online representative for the customer it is up to the customer to review our Terms and Conditions as they apply whether Tile Time Online enters the order or if the customer enters the order.
